Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Grove - Baby Tracking app ("Application") operated by Kristopher Ian Kuykendall ("Service Provider", "we", "us", or "our").
By downloading or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.
1. Use of the Application
The Application is designed to help parents and caregivers track baby-related activities including feeding, sleep, diaper changes, and pumping sessions. You may use the Application only for personal, non-commercial purposes.
You agree not to:
- Use the Application for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Application or its infrastructure
- Reverse engineer, decompile, or disassemble the Application
- Use the Application in any way that could damage, disable, or impair the service
2. Accounts
To use the Application, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at kuykkr01@gmail.com if you suspect unauthorized use of your account.
3. Subscription and Payments
The Application is free to download. Certain features require a paid subscription ("Grove Premium"). Subscriptions are offered on a monthly ($9.99/month) or annual ($79.99/year) basis.
- A 7-day free trial is available for new subscribers
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Payment is charged to your Apple ID account at confirmation of purchase
- You can manage and cancel your subscription in your iPhone Settings → Apple ID → Subscriptions
- No refunds are provided for partial subscription periods, except where required by law
- Apple handles all payment processing and refund requests for iOS purchases
Pricing is subject to change. We will provide reasonable notice of any pricing changes.
4. AI Features and Voice Logging
The Application includes AI-powered features including voice logging (powered by OpenAI Whisper) and the Ask Grovie AI assistant (powered by OpenAI GPT). By using these features, you acknowledge:
- Voice recordings are transmitted to OpenAI for transcription purposes only and are not stored by us beyond the active session
- AI responses from Ask Grovie are for informational purposes only and do not constitute medical advice
- You should always consult a qualified healthcare provider for medical questions about your baby
- AI features may occasionally produce inaccurate results
5. Not Medical Advice
The Application is a personal tracking tool only. Nothing in the Application, including data, insights, charts, AI responses, or any other content, constitutes medical advice, diagnosis, or treatment. Always seek the advice of your pediatrician or other qualified healthcare provider with any questions you may have regarding your baby's health.
In case of a medical emergency, call 911 or your local emergency services immediately.
6. Data and Privacy
Your use of the Application is also governed by our Privacy Policy. By using the Application, you consent to the collection and use of your data as described in the Privacy Policy.
You retain ownership of all data you enter into the Application (baby names, tracking logs, etc.). You grant us a limited license to store and process this data solely for the purpose of providing the Application's features to you.
7. Data Accuracy
The Application relies on data you enter. The Service Provider is not responsible for inaccuracies in tracking data resulting from user input errors. PDF reports and insights generated by the Application are based on user-entered data and may contain inaccuracies. Do not use them as a substitute for professional medical records.
8. Termination
You may stop using the Application and delete your account at any time by contacting us at kuykkr01@gmail.com. We reserve the right to suspend or terminate your account if you violate these Terms.
Upon termination, your right to use the Application ceases immediately. We may retain anonymized data as permitted by our Privacy Policy.
9. Disclaimer of Warranties
The Application is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. The Service Provider does not warrant that the Application will be error-free, uninterrupted, or free of viruses or other harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Application, including but not limited to loss of data, loss of revenue, or personal injury.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the "Last updated" date at the top of this document. Continued use of the Application after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.
